Welcome to 978host. These Terms of Service (“Terms”) govern your use of our websites, dashboards, and services (collectively, the “Services”) operated by 978host (“we”, “us”, “our”). By creating an account or purchasing a Service, you agree to be bound by these Terms.
1. Accounts
You must provide accurate information when creating an account and keep your login credentials secure. You are responsible for all activity that occurs under your account. Notify us immediately at support@978host.com if you suspect unauthorized access.
2. Billing & Renewals
Subscription services (hosting, managed WordPress, radio hosting, maintenance plans) renew automatically at the published price unless cancelled before the renewal date. One-time services (web development, custom plugins) are billed in full at purchase. All payments are processed by our payment partner Stripe; we do not store full card numbers on our servers.
Failed payments enter a 14-day grace period during which we will retry the charge and notify you. If payment is not restored, your service will be suspended. Suspended radio hosting accounts are permanently deleted 30 days after suspension; suspended web hosting accounts may have their data removed after 30 days of inactivity.
3. Refunds
Hosting and radio hosting subscriptions are refundable within 7 days of the initial purchase, provided no abuse has occurred. Subsequent renewals are not refundable, but you may cancel at any time and your service will remain active through the end of the paid period. Web development packages are non-refundable once project work has commenced; cancellations before work starts receive a full refund minus any third-party costs already incurred.
4. Acceptable Use
You may not use our Services to store, transmit, or broadcast content that is illegal, infringes intellectual property rights, contains malware, harasses individuals, or violates our partners’ acceptable use policies. For radio hosting specifically, you must hold the necessary music licensing (SoundExchange, ASCAP/BMI/SESAC, PRS, or equivalent in your jurisdiction) for the content you broadcast — we do not provide music licensing.
We reserve the right to suspend or terminate accounts that violate these terms, with or without prior notice depending on severity. We will make reasonable effort to notify you and give you a chance to remediate before terminating for non-egregious violations.
5. Service Levels
We target 99.9% uptime for managed hosting and radio hosting services. Scheduled maintenance is announced in advance via email and on our status page at /status/. We are not liable for downtime caused by your application code, third-party services you have integrated, DDoS attacks, force majeure events, or upstream provider outages.
6. Customer Content & Data
You retain ownership of all content and data you upload to our Services. You grant us a limited license to store, process, and transmit that content solely to operate the Services. We maintain daily backups for managed hosting accounts with 30-day retention; restore on request. You are responsible for keeping your own independent backups of business-critical data.
7. Web Development Deliverables
For custom web development engagements, ownership of the final delivered code transfers to you upon full payment. Third-party libraries, themes, or plugins included in your project retain their original licenses. We retain the right to reference completed projects in our portfolio unless you request otherwise in writing.
8. Liability
Our maximum aggregate liability for any claim related to the Services is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages including lost profits, lost revenue, lost data, or business interruption.
9. Changes to These Terms
We may update these Terms periodically. Material changes will be announced by email at least 14 days before they take effect. Continued use of the Services after the effective date constitutes acceptance.
